We provide this Site to you, the user, conditional upon your acceptance of these Terms.

Please read the Terms carefully. By visiting our Site and / or purchasing something from us, you agree to be bound by our Terms. These Terms shall apply to all users of the Site, including without limitation, users who are browsers, vendors, customers, merchants and / or contributors of content.

We reserve the right to refuse anyone access to the Site for any lawful reason at any time. Our store is hosted by Linuxweb. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

The headings used in these Terms are included for convenience only and are not relevant to the interpretation thereof.

By agreeing to these Terms, you represent that you are at least the age of majority according to the laws of your country of residence.

You are entitled to access the Site for the purpose for which it is provided. You may not use the Site for any illegal or unauthorised or malicious purpose, including but not limited to:

While Woodland Africa strives to provide accurate product and pricing information, errors may occur. If a product is listed at an incorrect price or with incorrect information due to an error, Woodland may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation.

Although we have endeavoured to display our products as accurately as possible, we cannot guarantee that your computer monitor’s display of any image or colour will be accurate.

Certain products or services may be available exclusively online through this Site. These products may have limited quantities and are subject to return or exchange only according to our Return Policy.

We reserve the right to disallow or limit the sales of our products to any party or region. We may exercise this right on a case-by-case basis. We further reserve the right to limit the quantities of any products that we offer or to discontinue any product at any time.

Your further agree that your comments will not contain libellous or otherwise unlawful, abusive, or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Site or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comment posted by you or any third-party.

Personal Information

Your submission of personal information through our online store is governed by our Privacy Policy. Information you provide other than credit card / payment information, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) be altered to conform and adapt to the technical requirements of connecting networks or devices. Credit Card information is always encrypted during transfer over networks.

Payment Method

We are subscribed to the Payfast Payment Portal, and you will be redirected to Payfast to complete your payment transaction. Your order will only be considered concluded and accepted once payment has been completed via Payfast. We DO NOT accept COD or card payments upon delivery.

Any refunds that become due, will not be made to any third-party accounts, but will be reversed via Payfast to the account from which the transfer has occurred. No exceptions shall be allowed.

Disclaimer of Warranties and Limitation of Liability

We do not guarantee, represent or warrant that your use of our Site will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the Site will be accurate or reliable.

Woodland Africa will not be liable for short delivery or defective goods unless you notify us of a claim in writing within 14 days of delivery. The notification must include the purchase order number of your purchase, as well as details of the claim.

Woodland Africa will not be liable in any way for loss, damage, costs or expenses (a) arising directly or indirectly from any failure or delay in performing any obligation under these Terms by reason of any event or circumstance outside the reasonable control of Woodland Africa, including but not limited to, any strikes, industrial action, failure of power supply or equipment, government action or Act of God or (b) arising directly or indirectly by reason of any negligence on the part of Woodland Africa, to the fullest extent provided by law. You expressly understand that Woodland Africa shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages (even if Woodland Africa has been advised of the possibility of such damages), including, but not limited to, damages for loss of profits or goodwill, resulting from your use of the Site or from any transaction you entered into with Woodland Africa.

Indemnification

You agree to indemnify Woodland Africa for any loss damages or expense, including reasonable attorney’s fees, claimed by any third-party due to or arising out of your breach of these Terms or arising from any unlawful or wrongful act on your part.

Severability

In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed to be severed from these Terms, whereby such determination shall not affect the validity and enforceability of the remaining provisions.

Trademarks

The trademarks, logos and service marks (“Marks”) displayed on the Site are the property of Woodland and other respective persons. Users are prohibited from using any Marks for any purpose, including but not limited to use as metatags on other websites or webpages, without the express written permission of the registered trademark holder. All information and content, including any software programs available on or through the Site (“Content”), is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes.

Effectiveness of Terms

These Terms and any other terms and conditions on this Site shall be effective: (a) whenever you access the Site; and (b) with respect to any event which arises from you having accessed the Site; and (c) with respect to any breach or violation by you of any of the Terms.

Entire Agreement

The failure by us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and any other terms and conditions posted by us on this Site constitute the entire agreement and understanding between you and us with respect to your use of the Site, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of South Africa.
